1. Agreement
These Terms of Service ("Terms") are an agreement between you and Inter Digital ("we", "us") for the Tycoon Go game on iOS, Android and the web (the "App"). By downloading, opening or playing the App, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the App.
2. Who can play
The App is suitable for all ages. If you are under 18, or under the age of majority where you live, please read these Terms with a parent or guardian. Children under 14 should use online modes only with a parent or guardian's permission.
3. Your licence to play
We give you a personal, non-exclusive, non-transferable, revocable licence to download and use the App for your own non-commercial entertainment, on devices you own or control, in line with these Terms and the rules of the store you got it from. You may not:
- copy, modify, distribute, sell, rent or sublicense the App;
- reverse engineer, decompile or try to extract the source code, except where the law allows it;
- use cheats, bots, scripts or modified clients to gain an unfair advantage or to automate play; or
- remove copyright or other notices from the App.
4. Virtual money and items
The App is free to play and has no in-app purchases. In-game money, properties, buildings and other items have no real-world value. They cannot be bought, sold, exchanged or redeemed for real money, goods or anything of value, inside or outside the App. Tycoon Go does not offer gambling or real-money prizes.
5. Rules of conduct
When you play online, you agree not to:
- harass, threaten, bully or abuse other players;
- use nicknames, room names or chat that are offensive, hateful, sexual, violent or illegal, or that impersonate someone else;
- share other people's personal information, or your own sensitive information;
- spam, advertise or send links to other services;
- exploit bugs, or deliberately disrupt games or our servers; or
- break any law, including laws on online content where you live.
Room hosts can remove players from their rooms. We may also remove content, end games, or block access for anyone who breaks these rules. To report a player, email us at support@inter-digital.org.
6. Nicknames and chat
You are responsible for the nicknames, room names and chat you create. You keep any rights you have in them, and you give us a free, worldwide licence to store, display and send them to other players as needed to run the game. This licence ends when the content is deleted under our Privacy Policy. Chat is filtered automatically, but we cannot review every message and are not responsible for what other players say.
7. Online service
Online modes need an internet connection and our servers. We work to keep them available, but we do not promise the service will always be available, uninterrupted or error-free. We may change, pause or end online features, or the App, at any time. Where we reasonably can, we will give notice before ending online play. Modes that play against the computer, or on one device, work without our servers.
8. Ownership
The App, including its code, artwork, characters, sounds, text and the Tycoon Go name and logo, belongs to Inter Digital or its licensors and is protected by intellectual property laws. Apart from the licence in section 3, these Terms do not give you any rights in the App. Tycoon Go is an original game and is not affiliated with or endorsed by any other board game brand.
9. App Store and Google Play
If you downloaded the App from Apple's App Store, you and we also agree that:
- these Terms are between you and Inter Digital only, not Apple Inc. ("Apple"), and Inter Digital, not Apple, is solely responsible for the App and its content;
- your licence is limited to using the App on Apple-branded products you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions;
- Apple has no obligation to provide maintenance or support for the App;
- if the App fails to meet any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation for the App;
- Inter Digital, not Apple, is responsible for any claims about the App, including product liability claims, claims that the App fails to meet legal or regulatory requirements, and consumer protection, privacy or similar claims;
- Inter Digital, not Apple, is responsible for investigating, defending, settling and discharging any claim that the App infringes a third party's intellectual property rights;
- you confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties; and
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, Apple may enforce them against you.
If you downloaded the App from Google Play, the Google Play Terms of Service also apply. If they conflict with these Terms on your use of the App, these Terms apply to the extent the law allows.
10. Disclaimers
To the extent permitted by law, the App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. Nothing in these Terms limits rights you have as a consumer that cannot be limited by law.
11. Limitation of liability
To the extent permitted by law, Inter Digital will not be liable for any indirect, incidental, special or consequential loss, or for loss of data, profits or goodwill, arising from your use of the App. Because the App is free, our total liability for any claim relating to the App is limited to the amount you paid us for it, if any. These limits do not apply to liability that cannot be excluded by law, such as liability for personal injury caused by our intentional misconduct or gross negligence.
12. Ending these terms
You can stop using the App at any time by uninstalling it. We may suspend or end your access if you seriously or repeatedly break these Terms, or if we must do so to comply with the law. Sections 4, 6, 8 and 10 to 13 continue to apply after these Terms end.
13. Governing law and disputes
These Terms are governed by the laws of the People's Republic of China (excluding, for this purpose, the laws of the Hong Kong and Macao Special Administrative Regions and Taiwan), without regard to conflict of law rules. We encourage you to contact us first so we can try to resolve any problem informally. If a dispute cannot be resolved within 30 days, either party may bring it before the competent people's court at the place where Inter Digital is located. If you live outside mainland China, this does not take away any protection you have under the mandatory consumer laws of your country.
14. Changes
We may update these Terms from time to time. We will post the new version on this page with a new "Last updated" date. If a change is significant, we will give clear notice before it takes effect. If you keep playing after the change takes effect, you accept the updated Terms.
